1. Introduction

Welcome to Marbles. These Terms and Conditions ("Terms") constitute a legally binding agreement between you and InfoNominal d.o.o. ("we," "our," "us," "Company"), located at Ulica Brune Bušića 36, 10020 Zagreb, Croatia (VAT number: 77309841348), governing your use of the Marbles application and website at www.yourmarbles.app (collectively, the "Service").

By using our Service, you agree to these Terms. Please read them carefully before using the Service.

If you do not agree to these Terms, you must not use our Service.

2. Definitions

Throughout these Terms:

"Service" refers to the Marbles application and website
"User," "you," and "your" refer to you, the person using our Service
"Account" means your registered account with Marbles
"Premium" refers to our paid subscription service
"Content" means any data, text, images, or other materials you create, store, or manage using our Service
"Free Tier" refers to our basic, non-paid service level

3. Service Description

3.1 Core Features

Marbles is a personal productivity application that provides:

Journal entries management
Habit tracking
List management
Note-taking capabilities
Image attachments

3.2 Free Tier Limitations

Free tier accounts are limited to:

20 journal entries
5 lists
20 notes
5 habits
1 image per journal entry/note/list item

3.3 Premium Features

Premium subscription includes:

End-to-end encryption
Unlimited journal entries, lists, notes, and habits
Unlimited image attachments
Priority support

4. Account Terms

4.1 Account Creation

To use the Service, you must:

Be at least 13 years old
Register for an account with valid information or use Google login
Secure your account with a strong password

4.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
Keeping your contact information current

We are not responsible for any loss or damage arising from your failure to comply with the above security obligations.

5. Payment Terms and Subscription

5.1 Payment Processing

All payments are processed by Paddle.com as the Merchant of Record:

Prices are displayed in Euros (EUR) excluding VAT/taxes
Final price includes applicable taxes based on your location
Payments can be made in local currencies at Paddle's exchange rates
Additional fees or taxes may apply based on your location

We are not responsible for any additional bank fees, currency conversion fees, or charges imposed by your payment provider.

5.2 Subscription Terms

By subscribing to Premium, you acknowledge:

Subscriptions automatically renew unless cancelled
Renewal occurs at the current rate at time of renewal
You must cancel before renewal to avoid charges
No refunds for unused subscription time

5.3 Price Changes

Price changes will be communicated:

Via email notification
Through in-app notifications
On our website

Changes apply only at next renewal period.

5.4 Refund Policy

14-day cancellation right if service hasn't been accessed
Limited cancellation rights after accessing premium features
Technical issues preventing service use will be reviewed individually
Contact support@yourmarbles.app for refund requests

5.5 Payment Issues

In case of payment failure:

Email notification will be sent
Multiple retry attempts over 5 days
Premium access continues during retry period
Account reverts to free tier after final retry failure

6. User Content and Rights

6.1 Your Content

You retain all rights to your content. By using our Service, you:

Maintain ownership of your content
Grant us limited license to host and provide access to your content
Are responsible for your content's legality and appropriateness
Must have necessary rights to content you upload

6.2 End-to-End Encryption

For Premium users utilizing end-to-end encryption:

You are solely responsible for maintaining your encryption passphrase
We cannot and will not recover or decrypt your data if you lose your passphrase
Encrypted backups require your passphrase for decryption
Loss of passphrase results in permanent inability to access encrypted data

We assume no responsibility for data loss resulting from lost or forgotten encryption passphrases.

6.3 Content Backup

While we maintain regular backups:

You are encouraged to maintain your own content backups
We provide export functionality for your data
Encrypted content requires your passphrase for backup restoration

7. Technical Requirements

7.1 Browser Requirements

To use Marbles, you must have:

Modern web browser with JavaScript enabled:
- Chrome (latest 2 versions)
- Firefox (latest 2 versions)
- Safari (latest 2 versions)
- Edge (latest 2 versions)
Cookies enabled for:
- Authentication
- Session management
- User preferences
Local storage enabled for:
- Offline functionality
- Application performance
- Data caching

7.2 Device Requirements

Minimum screen resolution: 320px width
Stable internet connection for synchronization
Sufficient storage space for offline data

8. Acceptable Use Policy

8.1 Prohibited Activities

You agree not to:

Use the Service for any illegal purpose
Upload malicious code or content
Attempt to gain unauthorized access
Interfere with service performance
Copy, modify, or reverse engineer the Service
Share account access with others
Circumvent any service limitations

8.2 Content Restrictions

You must not upload content that:

Infringes intellectual property rights
Contains malware or malicious code
Violates any applicable laws
Contains offensive or inappropriate material

9. Service Limitations

9.1 Service Availability

Service may be interrupted for maintenance

We do not guarantee uninterrupted or error-free service operation.

9.2 Data Portability

You may export your data:

Through built-in export functionality
In common file formats
Subject to rate limiting and size restrictions

Paddle for payment processing

Use of third-party services is subject to their respective terms and conditions.

10. Legal Framework

10.1 Governing Law

These Terms shall be governed by the laws of the Republic of Croatia. However, this choice of law does not override your rights granted by mandatory provisions of your local legal system, which cannot be derogated from by agreement, pursuant to Article 6(1) of Regulation (EC) No 593/2008 (Rome I).

10.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of the courts in the Republic of Croatia. For consumers, this jurisdiction clause does not affect your rights to bring legal proceedings in your local courts as provided by applicable consumer protection laws.

11. Termination

11.1 Account Termination by User

You may terminate your account:

At any time through account settings
By contacting support@yourmarbles.app

11.2 Termination by Us

We may terminate or suspend your account if:

You breach these Terms
We are required to do so by law
We cease providing the Service
Your account is inactive for over 12 months

11.3 Effects of Termination

Access to Premium features ends immediately
Data retention follows our Privacy Policy
No refunds for unused subscription time
Export your data before account deletion

After termination, encrypted data cannot be recovered if you haven't exported it.

12. Changes to Terms

We may modify these Terms:

To reflect changes in our Service
To comply with legal requirements
For other valid business reasons

Changes will be communicated through:

In-app notification
Website updates

Continued use of the Service after changes constitutes acceptance of modified Terms.

13. Disclaimers and Limitations

13.1 Service Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

13.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

Indirect or consequential damages
Loss of data due to user error
Issues caused by third-party services
Loss of access due to lost encryption keys

Our liability is limited to the amount paid for the Service in the 12 months preceding the claim.

15. Final Provisions

You may not assign your rights under these Terms without our prior written consent. We may assign our rights to any affiliate or successor in interest.

15.4 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
